By accessing, browsing, or purchasing products or services from Cowboy Kenny Coffee, LLC (“CKC,” “we,” “our,” or “us”), including through our website, mobile platforms, or subscription programs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our accompanying Privacy Policy. If you do not agree, you may not use our site or purchase our products.

2. Eligibility

You must be at least 18 years old to place an order or subscribe to recurring shipments. By placing an order, you represent that you are legally able to enter into a binding contract.

3. Products Offered

CKC sells roasted coffee products (ground, whole bean, pods, or related formats), apparel, hats, shirts, vests, and branded merchandise (“Products”). All products are intended for personal, consumer use only and are not authorized for resale, redistribution, or commercial service use unless you have received explicit written authorization from CKC.

We do not license, lease, transfer, authorize, or permit use of our brand, marks, logos, artwork, photography, naming conventions, slogans, product line names, or intellectual property in any form.

4. Product Availability & Pricing

All product descriptions, images, pricing, and availability are subject to change without notice. While we attempt to ensure accuracy, occasional typographical or system errors may occur. CKC reserves the right to refuse or cancel any order containing pricing or availability inaccuracies.

5. Payment Terms

Payment is due at the time of order or subscription enrollment. By purchasing, you authorize CKC and its payment processors to charge your selected payment method for the total order amount, including shipping costs and applicable taxes. Fraudulent orders will be reported and pursued legally.

6. Subscription Terms

CKC may offer recurring delivery subscriptions. By subscribing, you authorize automatic recurring billing until you cancel your subscription through your account portal or by email.

  • There is no minimum term unless stated otherwise.

  • Changes or cancellations must be applied before the next billing cycle to avoid additional charges.

  • Subscription orders are processed automatically and cannot be canceled or refunded once fulfilled.

7. Shipping & Delivery

  • CKC ships only within the 48 contiguous United States.

  • Estimated shipping times are provided as guidance and are not guaranteed.

  • CKC is not responsible for delays caused by carriers, weather, labor issues, or events beyond our control.

  • Risk of loss transfers to the consumer upon carrier acceptance.

8. Return & Replacement Policy

Because coffee is an ingestible consumable product, returns and exchanges are limited. Our full detailed Return Policy is maintained separately and incorporated by reference.

9. Allergen, Sensitivity & Consumption Disclaimers

Our coffee is sourced, roasted, and packaged by a third-party specialty roaster. While high standards are used, we do not guarantee allergen-free, gluten-free, nut-free, dairy-free, or other allergen-specific conditions. Consumers are responsible for reviewing ingredients and assessing personal health suitability.

CKC is not liable for adverse reactions, caffeine sensitivity, dietary impacts, pregnancy-related effects, or medical complications.

10. Intellectual Property & Brand Protection

All CKC names, logos, designs, product line names, packaging, photos, digital media, slogans, taglines, website text, product names, and other branding elements are the exclusive property of Cowboy Kenny Coffee, LLC.

No use, reproduction, duplication, modification, sale, licensing, upload, public display, AI-training, or creation of derivative works is permitted without written authorization.

Unauthorized use will result in legal action including damages, injunction, and recovery of legal fees.

11. User Conduct

You agree not to:

  • Attempt to impersonate CKC or misrepresent affiliation

  • Publish false product reviews or defamatory content

  • Harvest data, perform scraping, or use automated access

  • Interfere with site security or ordering systems

  • Use our brand or products in political, medical, or health-claims messaging

12. Limitation of Liability

To the fullest extent permitted by law:

  • CKC is not liable for indirect, consequential, incidental, punitive, or special damages

  • CKC’s total liability is limited to the amount you paid for the product involved

  • Results and experiences vary and are not guaranteed

13. Indemnification

You agree to hold harmless, defend, and indemnify CKC from claims arising out of misuse, resale, unauthorized branding use, misrepresentation, product misuse, or terms violations.

14. Governing Law & Dispute Resolution

These terms are governed exclusively by the laws of the State of Connecticut. Any dispute shall be resolved through binding arbitration on an individual basis and not through any class action.

CKC reserves the right to update or modify these Terms at any time. Continued use of the website or purchase of products constitutes acceptance of revised terms.
